These Terms of Service (“Terms”) govern your access to and use of GoCNcart.com (the “Site”), our Android app (CN Cart), and related services operated by 1688 Bangladesh Ltd. trading as GoCNcart (“we”, “us”, “our”). By using our Site/App, you agree to these Terms, our Privacy Policy, Refund & Return Policy, and Restricted & Prohibited Items Policy. If you do not agree, please do not use our services.

1) Service scope and model

  • Buying‑agent model: At your instruction, we source from Chinese marketplaces/manufacturers (e.g., 1688, Taobao), receive at our China warehouse (Guangzhou), perform basic QC/repack/consolidation, and arrange delivery worldwide via express (DHL/FedEx) or economy lines. For Bangladesh, dedicated lanes (Guangzhou/Hong Kong → Dhaka) are operated by 1688 Bangladesh Ltd.
  • Official API integrations: Product discovery (link/text/image reverse search) uses official APIs via our authorized technology partner. We are independent and not affiliated with Alibaba Group.
  • Estimates: Landed‑cost quotes are estimates and may change due to FX rates, carrier tariffs, volumetric weight, seller updates, or customs/tax rules.

2) Accounts & eligibility

  • You must be 18+ (or the age of majority in your jurisdiction). For business accounts, you confirm you are an authorized representative.
  • Provide accurate and up‑to‑date details (name, email, phone, shipping/billing address). We may request KYC for high‑value orders, fraud prevention, or customs compliance.
  • We may modify usernames that contain illegal/misleading/sensitive words. You are responsible for all activities under your account; keep credentials secure and notify support of any unauthorized use.

3) Fees, payments, and taxes

  • Service fee: 10% on product value only (China domestic delivery charges to our warehouse are excluded from the fee base). Shipping, add‑ons (QC/repack/storage), and applicable duties/taxes are charged separately.
  • Payments: International—Stripe/Payoneer (cards), Binance (where permitted). Bangladesh—Nagad, bKash, Rocket, CellFin, Upay, and bank transfer.
  • FX & charges: Multi‑currency checkout is supported; bank/gateway fees and exchange rates may apply.
  • Taxes & duties (DAP): Unless otherwise agreed in writing, international shipments are DAP; you are the Importer of Record (IOR) and pay duties/taxes upon arrival.
  • Chargebacks: Unjustified chargebacks may result in account suspension and fee recovery.

4) Orders, quotes, and cancellations

  • Quotes: We may correct obvious errors and cancel/refund orders affected by such errors or by seller stock/price changes.
  • Cancel before purchase: You may cancel before we purchase from the seller.
  • After purchase/processing: Cancellation may incur seller restocking, CN domestic return shipping, and processing fees per our Refund & Return Policy.
  • After international dispatch: Orders cannot be canceled.

Important: Shipping, risk, insurance

  • Risk transfer: Risk of loss passes when the carrier accepts your parcel from our China warehouse (or as per carrier terms). Optional insurance may be offered; if declined, only carrier standard liability applies.
  • Transit times: Delivery times are estimates. Delays due to customs, inspections, weather, peak seasons, or carrier constraints are outside our control.
  • Carriers: DHL/FedEx deliver under their own terms. 1688 Bangladesh Ltd. uses Guangzhou and Hong Kong ports for Bangladesh shipments.

5) Bangladesh shipping lanes (operated by 1688 Bangladesh Ltd.)

Category A — Guangzhou CN → BD: typically 7–14 days

Footwear, bags, jewelry, tools, electronics, computer accessories, ceramics, metals, leather goods, rubber/plastics, toys without batteries, PCBs/electrical parts, auto parts, adapters, machinery, microphones, garments, power supplies, cables, earphones, etc.

Not supported in A: liquids, aerosols, cosmetics, batteries, chemicals, or other hazardous items.

Category B — Hong Kong CN → BD: typically 20–25 days

Battery‑included items (UN3481‑compliant lines), regulated liquids/cosmetics (e.g., lipstick, oils, perfume), magnets/lasers, and other special‑handling items.

No counterfeit/IP‑infringing goods: such items are not accepted or shipped.

6) Warehousing, consolidation, and storage

  • We offer consolidation and repacking to optimize shipping costs and reduce volumetric weight.
  • Storage fees (including any free‑storage window) follow our current rates & terms. Unclaimed items or unpaid balances after the stated period may be treated as abandoned and disposed of per policy.

7) Quality check (QC) and after‑sales

  • Basic QC: visual checks for quantity/model/variant and obvious damage; not a factory‑level test.
  • Pro/video QC: may be available as an add‑on.
  • After‑sales: DOA/damage/shortage/wrong item are handled per our Refund & Return Policy within specified time windows and with required evidence. Cross‑border returns are generally not supported due to cost/customs complexity.

8) Restricted & prohibited items

  • We do not accept or ship prohibited items (e.g., counterfeit/replicas, certain batteries/aerosols, dangerous goods). Conditional items may require certifications (CE/FCC/RoHS) and local approvals. See our Restricted & Prohibited Items Policy.
  • Mis‑declaration: If you mis‑declare or send restricted items to our China warehouse and customs impose fines/penalties or seize goods, the costs and consequences rest with you; 1688 Bangladesh Ltd. will not bear such costs.

9) User conduct

  • Comply with all applicable laws (export/import, customs, sanctions/AML, consumer protection, IP).
  • No unlawful, harmful, defamatory, obscene, or infringing content. Do not solicit under‑valuation or mis‑declaration.
  • No security bypass, scraping, reverse engineering, or rate‑limit evasion.

10) Intellectual property

  • The Site/App, logos, text, graphics, software, and other content are owned by or licensed to us and protected by IP laws. You may not copy, distribute, or create derivative works without permission.
  • By uploading content (e.g., images for reverse search), you grant us a limited license to process and use that content solely to provide the services. You must have rights to the content you upload.
  • Third‑party trademarks (e.g., Alibaba, AliExpress, 1688, Taobao) belong to their respective owners.

11) Third‑party services and marketplaces

  • We are not the seller of marketplace goods and are not affiliated with Alibaba Group. Marketplace data (price/stock/specs/images) may change and is provided “as is”.
  • Payments, shipping, customs, analytics, and login/sharing may be provided by third‑party vendors under their terms. Your use of such services may be subject to their policies.

12) Disclaimers

  • Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement, to the maximum extent permitted by law.
  • We do not warrant uninterrupted, error‑free operation or the accuracy of third‑party data.

13) Limitation of liability

  • To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business interruption.
  • Cap: Our aggregate liability shall not exceed the greater of (a) the service fees you paid us in the six (6) months preceding the event, or (b) USD 100.

14) Indemnification

You agree to indemnify and hold us (and our directors, officers, employees, and agents) harmless from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your use of the services, your violation of these Terms, applicable law, or third‑party rights.

15) Suspension and termination

We may suspend or terminate your account or access to services for violations of these Terms, suspected fraud, illegal activities, non‑payment, or legal requests. Outstanding fees remain payable.

17) Governing law & dispute resolution

  • These Terms are governed by the laws of Bangladesh.
  • Disputes shall be resolved by arbitration in Dhaka under the Arbitration Act, 2001, or by competent courts in Dhaka, unless otherwise required by mandatory consumer laws.
  • If these Terms are translated, the English version prevails in case of conflict.

18) Changes to services and Terms

We may modify, suspend, or discontinue features/services and update these Terms from time to time. Material changes will be posted on the Site/App and, where appropriate, notified to you. The “Effective” date indicates the latest version.

19) Miscellaneous

  • Force majeure: We are not liable for delays/failures due to events beyond our reasonable control.
  • Severability: If any provision is unenforceable, the remainder remains in effect.
  • No waiver: Failure to enforce a provision is not a waiver.
  • Assignment: We may assign these Terms as part of a reorganization, merger, acquisition, or asset transfer.
  • Entire agreement: These Terms, together with referenced policies, form the entire agreement between you and us.

“Alibaba”, “AliExpress”, “1688”, and “Taobao” are trademarks of Alibaba Group. GoCNcart is not affiliated with, endorsed by, or an official agent of Alibaba Group. We use official API integrations via an authorized technology partner.
